Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the HiredOnSite website and platform (the “Service”) operated by HiredOnSite (“we”, “us”, “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms.

1. Jurisdiction and governing law

These Terms are governed by the laws in force in New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia in respect of any dispute arising from these Terms or the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By creating an account you represent that you meet this requirement and that the information you provide is accurate and current.

3. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You must promptly notify us of any unauthorised access at legal@hiredon.site.
  • We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.

4. Employer subscriptions and billing

Employer accounts may purchase paid subscription plans. Subscriptions are billed via Stripe on a recurring basis (monthly or annually) at the price displayed at checkout.

  • Cancellation — you may cancel your subscription at any time from your billing settings. Cancellation takes effect at the end of the current billing period.
  • Refunds — fees for partial billing periods are non-refundable, except where a refund is required by the Australian Consumer Law (ACL) or other applicable law.
  • Price changes — we may change subscription prices on at least 30 days' written notice.
  • Taxes — listed prices may exclude GST; applicable taxes will be added at checkout where required.

5. Acceptable use

You agree not to:

  • Post false, misleading, fraudulent, or discriminatory job listings or content;
  • Scrape, crawl, or otherwise extract data from the Service without our written consent;
  • Use the Service to harass, abuse, or harm other users, or to send unsolicited communications;
  • Attempt to circumvent any security or access-control feature of the Service, or interfere with its operation;
  • Upload malware, viruses, or other harmful code;
  • Use the Service in breach of any applicable law.

6. Content ownership and licence

You retain ownership of the content you submit to the Service (resumes, profile data, job listings, application materials). By submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, and transmit that content solely for the purpose of operating and providing the Service to you and other users (e.g. delivering your application to an employer).

The Service itself, including its software, design, and trademarks, is owned by us and our licensors. No rights are granted except as expressly set out in these Terms.

7. Indemnity

To the extent permitted by law, you indemnify us against any loss, liability, cost, or expense (including reasonable legal fees) arising from:

  • Your breach of these Terms;
  • Content you submit to the Service;
  • Your unlawful or negligent use of the Service.

8. Limitation of liability and consumer guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applies to you under the ACL or any other law where to do so would be unlawful.

Subject to those non-excludable rights, and to the maximum extent permitted by law:

  • The Service is provided “as is” and “as available”;
  • We exclude all implied warranties, including warranties of merchantability and fitness for a particular purpose;
  • Our aggregate liability to you for any claim arising out of or in connection with the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) AUD $100;
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.

9. Termination

You may terminate your account at any time from your account settings. We may suspend or terminate your access if you breach these Terms, if required by law, or if continued provision of the Service to you would be commercially impracticable. On termination, the provisions of these Terms which by their nature should survive (including ownership, indemnity, limitation of liability, and governing law) will continue to apply.

10. Changes to these Terms

We may revise these Terms from time to time. Material changes will take effect 30 days after we notify you (by email or in-product notice). Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
